Terms of sale
Last changed: 2026-11-03 (draft).
These terms apply when you buy an exocortex helmet or kit from CommandAGI Inc. ("we", "us"). exocortex is designed by Exocortex Labs. We are the seller, and our name is on your card statement ("EXOCORTEX").
1. What you buy
| product | what is in the box | what you do |
|---|---|---|
| Assembled helmet | the helmet assembled and tested: 66 contact tiles with 1,118 dry gold contacts, the hub, five cameras, a 2000 mAh battery, the printed shell; the beanie | charge it, install the app, put it on |
| Kit (not offered) | every board assembled by the board house, programmed and tested by us; the cables, screws, battery, cameras, beanie and printed shell parts | assemble it with the builder guide |
We do not sell a kit. A kit of parts for one helmet needs the same FCC and CE radio authorization as an assembled helmet.
The design files (boards, parts, shell) are on the site, so you can also build one yourself without buying anything from us. They are open: CERN-OHL-S-2.0 for the hardware, Apache-2.0 for the code, CC BY 4.0 for the documentation (licences). If you build one, these terms do not apply to what you build, and you are the builder of a home-built device.
Not yet authorized. This device has not been authorized as required by the rules of the Federal Communications Commission. This device is not, and may not be, offered for sale or lease, or sold or leased, until authorization is obtained. (47 CFR § 2.803(c)). We take pre-orders on that basis, and we will not deliver a unit until it is authorized. The same applies to the CE marking for the EU and the UKCA marking for the UK.
What exocortex is not. exocortex is a research and personal device for recording EEG, video and sound. exocortex is not a medical device and is not for diagnosing, treating or monitoring any condition. Do not use it for medical decisions.
You must be 18 or older to buy or use exocortex.
The state of the design. On the date of these terms, exocortex is designed and not yet built. The specifications on the site are design values. Contact quality, noise, comfort, battery life and heat have not been measured on a head. We will publish the measurements from the first units before we charge any balance or ship (§ 3).
2. Price, taxes and duties
- The price is in US dollars and is the price on the checkout page when you order (now $5,000 for an assembled helmet).
- US: sales tax is added at checkout where it applies.
- EU and UK: the price you see must include VAT, and import duty if we ship duty-paid (Consumer Rights Directive Art. 6(1)(e)).
- Other countries: you are the importer, and you pay the duty and import taxes that your country charges on delivery.
- Shipping cost is shown at checkout or before we charge the balance.
3. Payment
Payment is by card or another method that Stripe offers at checkout (for example Affirm, Klarna or Cash App Pay). Stripe processes it; we do not see or keep your card number (privacy). If you pay with a pay-later method, a refund goes back through that method, and that provider's own terms apply to your loan.
A pre-order is a fully refundable deposit.
- When you order, we charge a deposit of $250 per unit. The deposit holds your place in the line: units ship in the order the deposits were paid.
- You can cancel at any time before your unit ships, for any reason, and we refund the whole deposit. Use the "Cancel and refund" link on your order page (the page Stripe returns you to after checkout); the refund is made to your card at once. You can also write to us from the address you ordered with.
- Before we charge anything more, we email you the measurements from the first built units, the final price (not higher than the $5,000 you ordered at), the price for your country with its taxes, the shipping cost and the ship date.
- You then have 14 days to pay the balance or to cancel. If you cancel, or do not pay, we refund the whole deposit. We never charge the balance without your agreement at that time.
4. Delivery estimates and delays
- The date on the site is our estimate: we expect to ship the first 100 units by December 2027. It comes from the plan: prototypes built and measured first, then 4 to 7 months of radio, safety and battery testing and authorization . Your order confirmation gives your place in the line.
- If we cannot ship your unit by the date we gave you, we email you before that date with the new date and the reason. You can then cancel for a full refund of what you paid.
- If the new date is 30 days or less after the old one and you do not answer, we treat that as your consent to it. If it is more than 30 days after, we ship only if you tell us that you agree; if you do not agree, we cancel and refund you, without you having to ask (16 CFR 435.2).
- If we cannot ship at all, we refund everything you paid.
- We refund to the card or payment method you paid with, within one billing cycle of the cancellation (and within 14 days in the EU and the UK). We do not charge a cancellation fee.
- Delivery is to the address you gave at checkout. Tell us before we ship if it changes. Risk of loss passes to you on delivery.
5. Changes to the product before it ships
The design will change as we build and measure it. We can change parts, layout, materials and the number of contacts if the change keeps or improves what the product does. If a change reduces something that the site promised (for example, fewer cameras or a much shorter battery life), we tell you before we charge the balance or ship, and you can cancel for a full refund.
6. Returns and the warranty
- Returns describes how to return a unit, including the 14-day withdrawal right in the EU and the UK.
- Warranty describes the limited warranty. In the EU you also have the 2-year legal guarantee (Directive (EU) 2019/771); in the UK, your rights under the Consumer Rights Act 2015.
- Nothing in these terms takes away a right that the consumer law of your country gives you.
7. Kits: what the builder is responsible for
If you buy a kit, you assemble the helmet. We are responsible for the parts and boards we ship. We are not responsible for damage caused by assembly that does not follow the builder guide, for changes you make to the design, or for firmware you write. The warranty says what a kit's warranty covers.
8. Safety
Read the safety notes in the user guide before you wear the helmet. In particular:
- Charge it only off the head, with a certified USB charger. Do not wear the helmet while a USB cable is connected. The hub turns the contacts' supply off while USB power is present; do not defeat that interlock.
- Stop using it if it becomes hot, if the battery swells, or if your skin is irritated, and tell us (support).
9. Limits of liability
To be completed after legal review.
10. Governing law and disputes
To be completed after legal review.
11. Contact
