Terms of use
Last changed: 2026-11-03 (draft).
These terms apply when you use the exocortex site (my-exocortex.com), its API, your account, the exocortex app (desktop, web and phone) and the helmet's firmware. CommandAGI Inc. ("we") provides them. The privacy policy says what data we receive and what we do with it.
1. What these are for
- The site shows the design, sells pre-orders and publishes the design files.
- The app records what the helmet and your other sources produce (EEG, the cuff cameras, microphones, imported exports of your accounts, your notes) into one stream on your own computer, and lets you search it and ask questions about it (app).
- The helmet records EEG from 1,118 dry contacts, video from five cameras and sound from five microphones.
Not for medical use. exocortex is not a medical device and is not for diagnosing, treating or monitoring any condition. The app's interpretations (for example its guesses from EEG band power, or the guesses it makes about your relationships from your messages) are guesses made by simple models, not measured states. They are labelled as guesses in the app. Do not use them to make medical, legal, financial or safety decisions, and do not use them to judge an employee, a student or anyone else.
You must be 18 or older to use exocortex.
2. Your account
- You need an account to manage an order and to sign in to the app's online features. You do not need one to use the app on your own computer. Sign-in is an email link, then passkeys.
- Keep your devices and passkeys safe. Tell us at once if you think someone else has used your account.
- You can delete your account at any time (privacy § export and deletion).
3. Your data is yours
- What the app records stays on your computer unless you choose to send it somewhere. We do not get a copy.
- You choose which connectors, cloud models and external agents may read your data, and how much (app § exposure and agents). If you send data to a third party (for example a cloud model provider whose API key you enter), that third party's terms apply to it.
- We claim no rights in your recordings, notes or imports.
4. Recording other people
The cameras and microphones record the people around you. You are responsible for following the law where you use the helmet. In many places (for example California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington) you must have the consent of everyone in a conversation before you record it. Recording a conversation you are not part of is illegal almost everywhere. Video is restricted in private places such as bathrooms and changing rooms. In the EU, recording people in public can make you responsible for their data under GDPR.
So: tell the people around you that you are recording, turn the microphones on only when you need them, and turn the cameras off where recording is not allowed. Each camera board has a light that is on whenever its sensor has power, and the firmware has no setting to turn it off (camera § how it streams). In the current design the light sits under the knit, so other people may not see it: do not rely on it to tell them. Do not cover it, and do not change the firmware to defeat it.
Imported exports (messages, mail, social media) contain other people's words. Use them for your own records, and follow the law that applies to them.
5. Acceptable use
Do not use the site, the API, the app or the helmet to:
- record someone without the consent the law requires, or in a place where recording is prohibited;
- break the law, or help someone else to do so;
- attack, overload or probe the site or the API, except as allowed by our security policy;
- pretend to be someone else, or get into another person's account or data.
6. Safety
- Wear the helmet only on a battery. Charge it only off the head, with a certified USB charger. Do not wear it with a USB cable connected, and do not defeat the hub's interlock (hub § isolation and faults).
- Stop using it if it gets hot, if you smell burning, if the battery swells, or if your skin becomes red, sore or irritated. Tell us (support).
- Do not use it while driving, operating machinery, swimming, or anywhere a distraction or a loose cable could hurt you.
- Do not let anyone under 18 use it.
7. Open source
We intend to publish the designs, firmware and app under open licences (licences). Once they are published, those licences, not these terms, govern how you may copy, change and share the files. These terms cover the services we run (the site, the API, your account) and the products we sell. If you change the firmware or the hardware, you take on the risk of the change (warranty § what is not covered).
8. Changes and ending
- We can change these terms. We tell account holders by email at least 30 days before a change that reduces their rights takes effect.
- We can suspend an account that breaks § 5. You can stop using the services at any time.
- The app on your computer keeps working without our services: it does not need our servers to record or to search.
9. Disclaimers and limits
To be completed after legal review.
